By downloading, installing, or using My Toddler Coach ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

My Toddler Coach is a mobile application that provides AI-generated parenting advice and personalized children's stories. The App is designed to assist parents and guardians with common toddler challenges.

Important: The advice provided by this App is for informational purposes only and should not be considered a substitute for professional medical, psychological, or parenting advice. Always consult qualified professionals for serious concerns about your child's health or development.

3. User Eligibility

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Subscriptions and Payments

Free Tier: The App offers limited free functionality including a trial period with 10 free requests.

Paid Subscriptions: Premium features require a paid subscription. Subscriptions are billed through your Apple ID account and automatically renew unless cancelled at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time through your Apple ID settings. Cancellation will take effect at the end of your current billing period.

Refunds: Refund requests are handled by Apple according to their refund policies.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use the App to generate harmful, abusive, or inappropriate content
  • Share your account or subscription with others
  • Use automated systems to access the App excessively
  • Misrepresent the AI-generated content as professional advice

6. Intellectual Property

The App, including its design, features, and content, is owned by NearSea Tech and is protected by copyright and other intellectual property laws.

The stories and advice generated for you through the App are provided for your personal, non-commercial use. You may not republish or sell this content.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • The advice or stories generated will be suitable for your situation
  • Any errors in the App will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEARSEA TECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the App
  • Any advice or stories generated by the App
  • Unauthorized access to or alteration of your data
  • Any other matter relating to the App

9. Indemnification

You agree to indemnify and hold harmless NearSea Tech from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.
